3. Scope of Services

a. Portable Shipping Containers for Moving & Storage

• Containers are rented for a specified period to facilitate moving or storage.
• Delivery, pick-up, and storage services are subject to availability and location restrictions.

b. Dumpster Rentals

• Dumpsters are provided for temporary use for residential, commercial, or construction purposes.
• Customers must adhere to all Homeowner’s Association (“HOA”), local, state, and federal regulations regarding placement and use.

c. Curbside Junk Removal

• The Company provides removal of approved items from designated areas at the customer’s location.
• Certain materials, including hazardous waste, may be restricted.

4. Pricing and Payment

• Quotes and Estimates: All prices and estimates are subject to change based on service location, scope, and other factors.
• Taxes and Fees: Applicable taxes, fees, and surcharges will be included in the final bill.
• Payment Terms: Payment is due at the time of booking unless otherwise specified. The Company accepts major credit/debit cards and other approved payment methods.
• Cancellation Policy: Cancellations may be subject to fees depending on the notice provided. See Section 8 for details.

5. Customer Responsibilities

You agree to the following:

1. Provide accurate delivery and pick-up locations.
2. Ensure clear and safe access for container or dumpster placement and retrieval and junk removal services.
3. Comply with all local regulations and obtain necessary permits (if applicable).
4. Ensure containers and dumpsters are not overloaded or filled with prohibited materials (e.g., hazardous waste, flammable liquids).
5. Notify the Company immediately of any changes to your order.

Failure to adhere to these responsibilities may result in additional charges or cancellation of services.

6. Prohibited Uses

Customers may not use containers, dumpsters, or junk/waste removal services for:

• Storing or disposing of hazardous or illegal materials.
• Overloading containers beyond weight or capacity limits.
• Placing dumpsters in prohibited or unsafe locations.
• Conducting activities that violate local laws or ordinances.

The Company reserves the right to terminate services for any prohibited use. If the Company is required to cancel services due to prohibited use, all payments made under the contract will be non-refundable.

7. Service Availability and Limitations

• Geographic Restrictions: Services may not be available in all areas.
• Force Majeure: The Company is not liable for delays or non-performance caused by events beyond its control, including weather, natural disasters, or governmental actions.
• Scheduling Changes: Delivery and pick-up times are approximate and may be adjusted due to unforeseen circumstances.

8. Cancellation and Refund Policy

• Cancellation by Customer: Customers may cancel their reservation subject to the following:
  • More than 48 hours’ notice: Full refund.
  • Less than 48 hours’ notice: Non-Refundable.
• Cancellation by Company: The Company reserves the right to cancel orders due to weather, safety concerns, or customer non-compliance.
  • Weather: Full refund.
  • Safety Concerns: Full refund.
  • Customer Non-Compliance: Non-Refundable.

9. Liability and Disclaimer

a. Customer Liability

• Damage to containers, dumpsters, or equipment while in their possession.
• Costs incurred due to improper use or placement of containers/dumpsters.

b. Company Liability

• Damages to driveways, lawns, or property caused by container or dumpster placement. It is the Customer’s responsibility to ensure that specified areas are suitable for container and dumpster placement/retrieval (including roll/dumpster truck and load weights).
• Loss or damage to customer belongings stored in containers unless caused by gross negligence of the Company.
• Indirect, incidental, or consequential damage(s) arising from the use of our services.

10. Insurance and Indemnification

• Insurance: The Company may provide limited insurance for containers stored at its facility. Customers are encouraged to obtain additional coverage for stored items.
• Indemnification: You agree to indemnify and hold the Company harmless from claims, damages, or liabilities arising from your use of our services or violation of these Terms.

11. Privacy and Data Protection

Your use of our website and services is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

12. Third-Party Links

Our website may contain links to third-party websites for informational purposes. The Company is not responsible for the content, policies, or practices of third-party sites.

13. Governing Law and Dispute Resolution
